1. Who can buy wholesale
Wholesale is for businesses that will resell or serve our cookies to their own customers: pizza shops, sandwich shops, coffee shops, grocery markets, restaurants, caterers, and similar. To buy at wholesale you apply through the form on our Wholesale page with your business name, address, the kind of business, and a phone number. Put a phone number on it. Emails get lost in spam folders, ours included.
We review every application by hand and approve or decline by email. We can decline any application and we do not have to say why. Approval is for the business named on the application, not for the person who filled it in. Once you are approved you get a login and a passcode for the wholesale side of the site.
2. Pricing
Wholesale prices are shown only to approved accounts after login. They are not published, and they are not available to consumers, to unapproved accounts, or through the consumer side of the site. If you are approved, the prices you see in the wholesale collection are your prices; they include no shipping and no tax.
Standard flavors are one price. A small number of premium flavors carry a higher price, marked on the product. Protein cookies are not available at wholesale.
Prices can change with email notice, and we will give you enough notice to reprice your menu. Orders placed before a change are honored at the old price. Volume pricing and account-specific rates, where we offer them, are a written arrangement between us and your account and are not transferable.
Sharing wholesale pricing publicly, or reselling at wholesale to another business, ends your account.
3. Minimums
We keep wholesale minimums low on purpose, so a small shop can start small and grow. Your minimum first order, your reorder minimum, and the case size per flavor are set for your account and confirmed in your approval email. Ask us about a trial order; we can usually work something out.
4. Ordering
Approved accounts order by the case in the wholesale collection on this site, with their login, and pay at checkout by card, unless we have agreed payment terms with you in writing. Shipping is shown at checkout, or set by your written arrangement if you have one.
We bake to order. Lead times are fast, and we will tell you the ship or pickup date when we confirm the order. Around holidays we tell you the last order date ahead of time. Custom flavors, white-label packaging, and retail signage and displays are quoted separately by email at sales@insideoutcookie.com.
5. Payment
Payment is by card at checkout. If we have agreed net terms with you in writing, payment is due on the invoice we send, on those terms. We can grant, change, or withdraw net terms, and we will do it in writing. We can hold or cancel shipments on accounts with an unpaid balance, and unpaid invoices accrue interest at the maximum rate the law allows, plus reasonable collection costs.
6. Shipping and pickup
How your order is packed and shipped, and how to store it when it arrives, is set out on the product and in your order confirmation. Freight is shown at checkout, or on your invoice if your account is on written terms; the free-shipping benefit on consumer subscriptions does not apply to wholesale. Local accounts can pick up at the bakery by arrangement. Risk of loss passes when the carrier picks up or when you or your carrier collects. Inspect on arrival and report shortages or damage with photos as soon as you open the shipment, and we will credit or replace.
7. Handling, storage, and serving
You are responsible for storing and handling the product safely once it is delivered: follow the storage and heating instructions we provide, and do not sell past the use-by date we mark. You are responsible for food-safety compliance in your own premises, including displaying allergen information to your customers. Every bag carries an ingredient sticker and we will provide the ingredient and allergen statement for every flavor you carry; you agree to pass it on. Our kitchen handles wheat, dairy, eggs, peanuts, tree nuts, and sesame, and every cookie is made in the same room, so cross contamination is possible. "Gluten and Dairy Friendly" describes the recipe, not a certified allergen-free facility, and you must not represent it as one.
8. Resale rules
You may sell our cookies in your physical location, through your own delivery and takeout, and through your own catering. You may not sell them through an online store of your own, sell them to another reseller, or repackage them under our name. White-label packaging is available by arrangement and is the only permitted way to sell them under a name other than ours. If you want to sell them at a fair, festival, or market, ask us first; we run our own event schedule and we will tell you whether it conflicts.
9. Our brand
While your account is active you may use the Inside Out Cookie name, logo, and the photos and signage we supply to identify and sell our cookies in your business, in the form we supply them. You may not alter them, use them for anything else, or suggest we endorse your business generally. This permission ends when the account ends. If you sell under white label, you may not use our name at all unless we agree in writing.
10. Ending the relationship
Either of us can end the wholesale account at any time by email. Orders already paid for ship. Ending the account does not cancel unpaid invoices. We can suspend or end an account immediately for unpaid invoices, resale outside these terms, sharing wholesale pricing, food-safety problems, or conduct that damages our reputation.
11. Warranty and liability
We warrant that the cookies are made in compliance with applicable food law and match the product description when they leave us. Beyond that, all other warranties are disclaimed, and our liability to a wholesale account is limited to the price of the affected order.
12. Privacy
Information you give us in an application or an order is used to run your account and is covered by our Privacy Policy.
13. Law
Pennsylvania law. Disputes are resolved as set out in the dispute section of our Terms of Service: individual arbitration with a small-claims carve-out, and Centre County, Pennsylvania for anything not arbitrable.
